No. 01Acceptance Of Terms

These Terms and Conditions ("Terms") govern your use of https://serenitygarments.com ("the Site") operated by Serenity Horizon Private Limited ("Serenity Garments", "we", "us", "our"). By accessing, browsing, or making a purchase from the Site, you accept these Terms in full. If you do not agree, please do not use the Site.

These Terms are published in accordance with Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and constitute an electronic record under the Information Technology Act, 2000.

No. 02Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to make a purchase on the Site. By placing an order, you represent that you meet these requirements.

No. 03Account & Order Information

You agree to provide accurate, current, and complete information at checkout, including correct name, contact details, and delivery address. You are responsible for any consequences arising from inaccurate information you provide.

We reserve the right to cancel any order if we suspect fraud, mis-representation, or breach of these Terms.

No. 04Products, Pricing & Availability

All products displayed on the Site are subject to availability. We reserve the right to:

• Modify product descriptions, prices, photographs, or availability at any time without prior notice
• Limit quantities of any product per customer or per order
• Discontinue any product at any time
• Refuse or cancel orders that contain pricing or descriptive errors, even after confirmation

All prices are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST). The final payable amount, including any shipping or handling charges, is displayed before you confirm the order.

Product photographs are representative. Minor variation in colour or texture may occur due to monitor settings and the natural character of premium fabrics.

No. 05Orders & Acceptance

Placing an order constitutes an offer to purchase. The contract is formed only when we issue an order confirmation email to you. Until that point, we may, at our discretion, decline any order.

Each order generates a unique Order Number which is also used as the Merchant Transaction ID across our systems for reference. Please retain this number for any future correspondence.

No. 06Payment Methods

We accept the following payment methods:

• UPI via Google Pay, PhonePe, Paytm, BHIM, and other UPI-enabled apps
• Cash on Delivery (COD) — an additional handling fee of ₹49 applies

All online payments are processed through our PCI-compliant payment partner. We do not store payment credentials on our servers.

Where a payment attempt fails or is reported as unsuccessful by the gateway, no order is confirmed and you are free to reattempt or choose an alternate payment method.

No. 07Shipping & Delivery

Shipping terms are detailed in our Shipping Policy. In brief:

• We ship across India to all serviceable pincodes
• Standard delivery time is 5–9 business days from order confirmation
• Risk and title in the goods pass to you on delivery

We are not liable for delays caused by force majeure, courier disruptions, incorrect addresses provided by the customer, or unforeseen logistic issues.

No. 09Use Of The Website

You agree to use the Site only for lawful purposes. You agree not to:

• Use the Site in a way that breaches Indian law or any applicable regulation
• Attempt to gain unauthorised access to any part of the Site, our servers, or related systems
• Introduce viruses, trojans, worms, or any malicious code
• Use any automated system (bots, scrapers) to access or copy content from the Site
• Reproduce, duplicate, copy, sell, or exploit any portion of the Site without our prior written consent

All content on this Site — including text, logos, photographs, designs, illustrations, and software — is owned by or licensed to Serenity Horizon Private Limited and is protected under Indian copyright, trademark, and intellectual property laws.

"Serenity Garments" and the Serenity wordmark are trademarks of Serenity Horizon Private Limited. You may not use them without our prior written consent.

You are granted a limited, non-transferable, revocable licence to view and use the Site for personal, non-commercial purposes only.

No. 11User-Generated Content

If you submit reviews, photographs, comments, or any other content to us, you grant Serenity Horizon Private Limited a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and publish such content for purposes related to the Site, marketing, and product display, with attribution where appropriate.

You warrant that any content you submit is your original work, does not infringe any third-party rights, and is not unlawful, defamatory, obscene, or otherwise objectionable.

No. 12Prohibited Goods

The Site only sells legally permitted apparel and accessories. We do not deal in: tobacco, alcohol, drugs, weapons, counterfeit goods, lottery products, adult content, or any item restricted under Indian law.

No. 13Disclaimers

The Site and all products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties — whether express or implied — including fitness for a particular purpose, merchantability, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

No. 14Limitation Of Liability

To the maximum extent permitted by applicable Indian law, Serenity Horizon Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or purchase of any product.

In any event, our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.

No. 15Indemnification

You agree to indemnify and hold harmless Serenity Horizon Private Limited, its directors, employees, and partners from any claim, loss, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms or any applicable law.

No. 16Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, war, riots, strikes, lockdowns, pandemics, government action, courier disruption, infrastructure failure, or natural disaster.

No. 17Modifications

We reserve the right to modify these Terms at any time. The revised Terms will be effective from the date of posting on the Site. Continued use of the Site after modifications constitutes acceptance of the revised Terms.

No. 18Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts at Indore, Madhya Pradesh.
